Acceptance of Terms

By downloading, installing, or using Vivya PDF (the "Application") developed by Vivya Corp ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Application.

These Terms apply to all users of Vivya PDF, including the desktop application and any associated browser extensions.

License Grant

Subject to your compliance with these Terms, Vivya Corp grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install one copy of the Application on your personal device(s).
• Use the Application solely for your personal or internal business purposes.
• Install and use any associated browser extensions in supported browsers.

This license does not include the right to sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Application.

Restrictions

You agree not to:

• Copy, modify, or create derivative works of the Application.
• Reverse engineer, decompile, or disassemble the Application.
• Remove or alter any proprietary notices or labels on the Application.
• Use the Application to process, store, or transmit illegal, infringing, or harmful content.
• Use the Application in any manner that violates applicable laws or regulations.
• Attempt to gain unauthorized access to any systems or networks related to the Application.

Intellectual Property

The Application, including all software, design, text, graphics, and other content, is the exclusive property of Vivya Corp and is protected by copyright, trademark, and other intellectual property laws.

Your documents and files remain your property at all times. We claim no ownership over any content you process using the Application.

Privacy

Your use of the Application is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Vivya PDF is designed to work offline — your documents are processed locally on your device and are never transmitted to our servers.

AI Features & Third-Party Services

Vivya PDF includes optional AI-powered features powered by Google Gemini. When you use these features:

• Your document content may be transmitted to Google's servers for processing.
• Use of AI features is subject to Google's Terms of Service.
• AI features require an active internet connection and are entirely optional.
• We are not responsible for the accuracy or completeness of AI-generated outputs.

Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Application at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIVYA CORP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APPLICATION.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid for the Application in the twelve (12) months preceding the claim.

Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of these Terms. Upon termination, you must cease all use of the Application and destroy all copies in your possession.

We reserve the right to terminate or suspend your access to any online features of the Application at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tiruchirappalli, Tamil Nadu, India.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the Application and updating the "Last updated" date at the top of this page. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.
